SmartCubic Terms of Service
Article 1. Purpose
These Terms govern the conditions of use and the rights, duties and responsibilities of GLOBALIZ LTD (the “Company”) and members in relation to SmartCubic, MetaCubic, Reward, CubicPass, Friend Connections, Comments, Cubic App and related services.
Article 2. Definitions
“SmartCubic ID” is the unified member identifier used across SmartCubic services. “MetaCubic” is a profile, business, organisation and content service that may be public or private. “Reward” is a benefit or reward function used between members or Business Members. “CubicPass” is an access method under which the Company supplies a SmartCubic ID and authentication information to minimise personal-information input. “Friend Connection” is a connection created by request and acceptance. “Comment” means an opinion, review, reply or other user submission. “Cubic App” is an icon-based search and connection service created by members. “User Content” includes Comments, icons, images, descriptions, links, profiles and other material submitted by members.
Article 3. Acceptance and Statutory Rights
A member may accept these Terms through registration, CubicPass activation or another method offered by the Company. These Terms do not exclude mandatory privacy, consumer or other rights that apply to the member in New Zealand, Korea or another applicable jurisdiction.
Article 4. One SmartCubic ID
The Company may use one SmartCubic ID across MetaCubic, Reward, CubicPass, Friend functions, Comments and Cubic App. Where the SmartCubic ID identifies an individual, or can identify the individual when combined with other information, it is protected as personal information as required by applicable law.
Article 5. Registration and Optional Information
Members may register directly or use CubicPass. A phone number is not currently mandatory. As a general principle, refusal to provide optional information should not prevent use of a basic service unrelated to that information.
Article 6. CubicPass
CubicPass is not a separate ID system. It is a method of providing a SmartCubic ID and authentication information while minimising personal-information input. Login, security, Reward and other necessary usage records may still be generated.
Article 7. Public and Private MetaCubic
Members may use a public or private MetaCubic page where supported. Public information may be viewed, searched, copied or captured by internet users. The Company cannot guarantee deletion of all independent third-party copies.
Article 8. Contact Information
Phone numbers are optional. Members who do not want a personal number public are encouraged not to enter it. Where public telephone contact is needed, a business or dedicated public contact is recommended. Email addresses may currently be visible on MetaCubic or Friend-related areas, and members should review the relevant visibility.
Article 9. Friend Connections
Members may create Friend Connections through requests and acceptance. Under the current system, SmartCubic ID, name and email may be displayed in Friend-related MetaCubic areas. A phone number is not standard Friend Information merely because a connection exists, although a number voluntarily published on a public MetaCubic page may be visible.
Article 10. Reward
Reward operates using the SmartCubic ID. Under the current system a Reward recipient may be able to see the sender's SmartCubic ID. Sending a Reward does not by itself disclose the sender's password or internal private Company information.
Article 11. Right to Post Comments
Logged-in members may post Comments where enabled. Comments posted on public pages may be visible to the public. The member who posts a Comment bears primary responsibility for the content submitted.
Article 12. Prohibited Comments
Members must not post deliberately false, deceptive or fraudulent content; impersonation; abusive or seriously insulting content; repeated attacks, harassment or threats; unlawful defamation or reputational harm; hateful or discriminatory attacks; obscene or unlawful content; unauthorized personal-information disclosure; spam or repetitive advertising; phishing or malicious links; or content infringing copyright, trade marks, image rights or other rights.
Article 13. Comment Moderation and Reporting
The Company does not promise to pre-review every Comment. It may review content following a report, rights-holder request, legal requirement or its own review, and may hide or remove Comments or restrict Comment functionality or accounts. User responsibility does not exclude obligations that the Company itself cannot lawfully exclude.
Article 14. Cubic App
Cubic App is an icon-based search and connection service created by members using icons, titles, descriptions, URLs, tags, categories and similar information. Cubic App information is generally User Content submitted by its creator.
Article 15. Cubic App Creator Responsibility
Creators must review the accuracy, currency and legality of submitted information and have sufficient rights to use icons, images, logos, descriptions and links. They must not submit phishing, malware or fraudulent destinations, falsely claim official affiliation or approval, promote unlawful goods/services, or infringe privacy or intellectual-property rights.
Article 16. Licence for User Content
Members retain their rights in User Content. To the extent reasonably necessary to operate SmartCubic, a member grants the Company a non-exclusive, royalty-free permission to store, display, search, index, cache, technically format and resize User Content. Retention after deletion is limited to what is reasonably required for legal retention, security backups or disputes and is governed by the Privacy Policy and applicable law.
Article 17. External Links and Search Results
Cubic App and SmartCubic search results may include links to external sites. External products, services, content and privacy practices are governed by the relevant external operator. Inclusion in search results or linking does not itself constitute an endorsement or guarantee by the Company.
Article 18. Rights-Infringing Content
The Company may receive complaints alleging infringement of copyright, trade marks, privacy, reputation, image/publicity rights or other rights. Where there is a reasonable basis, the Company may temporarily restrict, hide or remove content or take other appropriate action. Repeat infringers may be restricted.
Article 19. Personal Information of Other People
Members must not publish another person's phone number, email address, home address, identity information, images or other personal information in Comments, MetaCubic, Cubic App or other public areas without appropriate authority or another lawful basis.
Article 20. Children and Minors
The Company takes the privacy and online safety of minors into account. Where Korean law applies and consent is required to process personal information of a child under 14, consent of the legal representative and verification may be required. Minors are strongly encouraged not to publish direct contact details, home address, school/class details, live location or schedule, government identifiers or financial information in public MetaCubic pages, Comments or Cubic Apps.
Article 21. Prohibited Conduct Toward Minors
Grooming, sexual exploitation or solicitation, threats, harassment, improper attempts to arrange meetings, and deceptive attempts to collect a minor's personal information, images or contact details are prohibited. The Company may restrict content, accounts or functionality where it reasonably considers that a minor's privacy or safety is at material risk.
Article 22. Requests by Minors and Guardians
Privacy requests involving a minor, parent, guardian or legal representative will be handled in accordance with applicable law, the minor's own privacy rights, age and capacity, and appropriate verification. Where guardian authority or consent must be verified, the Company may request minimum information reasonably necessary for verification.
Article 23. Business Members
Business Members must not use SmartCubic IDs, Friend Information, email addresses, phone numbers or other customer information beyond legitimate transaction or service purposes for unauthorized collection, combination, advertising, sale or tracking.
Article 24. Prohibited Conduct
Hacking, account theft, automated scraping or harvesting of personal information, comment flooding, spam, phishing, fraud, malicious links, Reward manipulation, unauthorized SmartCubic ID tracking, sale of personal information, rights infringement and other unlawful activity are prohibited.
Article 25. Service Restrictions
Where there is a material breach, security risk, fraud, privacy misuse or repeated rights infringement, the Company may remove content or restrict features or accounts. Where urgent safety or security action is necessary, action may be taken before notice with notice provided where reasonably practicable.
Article 26. System Records
To the extent permitted by law, the Company may process login, Friend, Reward, Comment, Cubic App creation/modification, complaint and security records for service delivery, safety, spam/fraud prevention, complaint handling, dispute resolution and legal compliance.
Article 27. Server Location and Overseas Processing
SmartCubic's primary servers are located in the Republic of Korea. Information relating to members in New Zealand and other countries may therefore be stored or processed in South Korea. Where personal information is disclosed to or processed by a separate overseas provider, applicable legal requirements will be assessed.
Article 28. MCP and External AI
MCP is not currently connected to the SmartCubic member personal-information system. If MCP or external AI integration materially changes processing, the Company will carry out any assessment, notice, consent or other steps required by applicable law.
Article 29. Company Liability
The member who submits a Comment, Cubic App or other User Content bears primary responsibility for that content. This does not exclude liability of the Company for intentional misconduct, gross negligence, privacy obligations, consumer rights or other liabilities that cannot lawfully be excluded.
Article 30. Account Termination and Content
Members may request termination using a method provided by the Company. After account or content deletion, information may be retained on a limited basis where required for law, disputes, security or backup-cycle completion, as described in the Privacy Policy.
Article 31. Amendments
These Terms may be amended when laws, services, Comment or Cubic App functionality, or personal-information processing practices change. Material changes will be notified as required and separate consent will be obtained where legally required.
Article 32. Governing Law and Disputes
The contractual relationship is generally governed by New Zealand law, without excluding mandatory privacy, consumer or other rights applicable to a user in Korea or another jurisdiction. The parties should first seek good-faith resolution, and New Zealand courts may have jurisdiction to the extent permitted by law.

SmartCubic Privacy & Customer Information Protection Policy
1. Privacy Principles
GLOBALIZ LTD seeks to explain transparently what personal information SmartCubic processes and when information may become public, to process information within purposes reasonably necessary for the service, and to minimise unnecessary personal-information input.

3. Services Covered
This Policy applies to SmartCubic accounts, MetaCubic, Reward, CubicPass, Friend functions, Comments, Cubic App and related SmartCubic functionality provided by GLOBALIZ LTD.
4. Direct Registration Information
For direct registration, information processed may include SmartCubic ID, name, email address, password authentication information, phone number (optional), country/language, profile information and other information voluntarily entered. Mandatory and optional fields should match the actual registration interface.
5. CubicPass Information
CubicPass processing may include SmartCubic ID, authentication information, login/access records, Reward records, Friend records, MetaCubic usage, customer-support and security records. CubicPass minimises personal-information input but is not a completely anonymous service.
6. Phone Numbers
A phone number is not currently mandatory. Members who do not want a personal number to be public are encouraged not to enter one. For public MetaCubic use, a business or dedicated public contact number is recommended. A phone number is not standard Friend Information merely because a Friend Connection exists.
7. Email Addresses
Email may be used for account and service purposes and may currently be displayed in MetaCubic or Friend-related public areas. Where displayed on a public page, it may be viewed by internet users.
8. Public and Private MetaCubic
SmartCubic ID, name, email, profile, photographs, business information and other content published on a public MetaCubic page may be visible to internet users. A private setting limits public-page visibility but does not mean internal account and operational logs are not processed.
9. Friend Information
To provide Friend functions, the Company may process SmartCubic ID, name, email, Friend Request/acceptance/removal records and relationship status. Under the current system, SmartCubic ID, name and email may be displayed in Friend-related areas.
10. Reward Information
Reward processing may include sender/recipient SmartCubic IDs, Reward amount, transaction time, status and related records. Under the current system, a Reward recipient may be able to see the sender's SmartCubic ID.
11. Comment Information
Comment processing may include the Comment content, author SmartCubic ID or account identifier, time of posting, related page/content information, complaint records and usage records reasonably necessary for spam prevention, security and dispute management. Comments and displayed author information on public pages may be public.
12. Personal Information in Comments
If a member writes personal information directly into a Comment, that information may also become public. Members should not post private email addresses, personal phone numbers, home addresses, identity or financial information, or another person's personal information unless there is an appropriate lawful reason.
13. Cubic App Information
Cubic App processing may include the creator SmartCubic ID, icons, titles, descriptions, URLs, categories, tags, images/logos, creation/modification information and other creator-submitted information. Personal information voluntarily placed in a public Cubic App may be visible to internet users.
14. Purposes for Cubic App Processing
Cubic App information may be processed for icon search, link delivery, search-result generation, user-created pages, indexing/caching/technical display, complaint handling, malware/phishing/fraud prevention, copyright and privacy protection, service security and operation.
15. Automatically Generated Information
Use of the service may generate IP addresses, access dates/times, device/browser information, login history, security logs, feature usage and error/diagnostic records.
16. Purposes of Processing
Personal information may be processed for registration/account administration, authentication, MetaCubic, Reward, CubicPass, Friend, Comment and Cubic App functionality, customer support, fraud/spam/misuse prevention, security, complaint/rights handling, dispute resolution and legal compliance.
17. Public Display and Third-Party Disclosure
The Company does not generally sell or disclose personal information to independent third parties without an appropriate lawful basis. However, service functionality initiated or selected by a member may display public MetaCubic information, Friend-related SmartCubic ID/name/email, a Reward sender SmartCubic ID, public Comments and public Cubic App information to other users or internet users.
18. Restrictions on Reuse
Public visibility does not itself grant a third party an unrestricted right to harvest email/phone information, track or combine SmartCubic IDs, profile users, send spam, advertise, sell or otherwise reuse personal information. The Terms prohibit unauthorized secondary use.
19. Children Under Korean Law
Where Korean law applies and consent is the legal basis required for processing personal information of a child under 14, the Company may require consent of the legal representative and verification and may process minimum representative information necessary for that verification. Notices intended for children should, where applicable, use clear and easy-to-understand language.
20. Children and Young People in New Zealand
In New Zealand, privacy rights apply regardless of age. The Company seeks to take age, capacity and the sensitivity of information into account when assessing whether collection or disclosure is fair and reasonable. Requests by parents or guardians are handled with regard to the young person's own privacy rights and applicable law.
21. Protecting Minors in Public Areas
Minors are strongly encouraged not to publish personal mobile numbers, personal email addresses, home address, school/class information, live location/schedules, government identifiers or financial information on public MetaCubic pages, Comments or Cubic Apps. The Company may restrict or remove public information where it reasonably considers there is a material privacy or safety risk to a minor.
22. Content About Minors Submitted by Others
Members must not publish a minor's personal information, images, contact details, location or school information without appropriate authority or another lawful basis. Grooming, sexual exploitation or solicitation, threats, harassment, or attempts to collect a minor's personal information for harmful purposes are prohibited.
23. Service Providers
Where hosting, servers, email, payments, security, customer support or other functions are outsourced, the Company will disclose actual providers, purposes, categories of information and processing countries to the extent required by applicable law. 24. Server Location and Overseas Processing
SmartCubic's primary servers are located in the Republic of Korea. Personal information relating to New Zealand users may therefore be stored or processed in South Korea. Where information is disclosed to or processed by a separate overseas provider, applicable Korean and New Zealand cross-border requirements will be assessed.
25. Retention
Actual retention periods must be finalised and published: member account [period], Friend records [period], Reward records [period], Comments and Comment complaints [period], Cubic App content/modification/complaint records [period], access/security logs [period], customer support/dispute records [period], consent and guardian-consent verification records [period]. Records required by law may be retained on a limited basis for the required period.
26. Deletion
When the processing purpose has ended and no legal retention obligation applies, personal information will be deleted or destroyed using methods appropriate to the actual system and applicable law. Backup copies may be deleted according to defined backup cycles and security policies.
27. Security Measures
Taking account of actual service size and risk, the Company seeks to use reasonable technical and organisational measures such as administrator access controls, protection of authentication information, access/security logs, abnormal-access detection, backups, incident response, anti-scraping/anti-spam controls and complaint handling. The Company will not claim that a security control exists where it has not actually been implemented.
28. Privacy Breaches
If unauthorised access, loss, improper disclosure or another privacy breach is suspected or confirmed, the Company will take steps to contain it, assess cause and impact, and make notifications or reports to affected individuals or regulators where required by applicable law.
29. Individual Rights
Users may exercise access, correction, deletion, objection/restriction, withdrawal of consent or other rights available under applicable law. Reasonable verification may be required to avoid disclosing another person's information.
30. Requests by Children and Guardians
Requests relating to a child under 14 and a legal representative under Korean law will be handled in accordance with applicable law. In New Zealand, a parent or guardian request is not treated automatically as an unrestricted right to all information; the young person's privacy rights, age/capacity and applicable law are considered.
31. Content and Rights Complaints
If personal information, copyright material, trade marks, reputation or other rights are believed to have been infringed through a Comment or Cubic App, a report may be sent to info@smartcubic.com. The Company may review the report and consider restrictions, removal or other action required by law or policy.
32. MCP and AI
MCP is not currently connected to the SmartCubic member personal-information system. If MCP or external AI integration changes the scope of processing, the Company will carry out appropriate privacy-impact/risk assessment and any notice or consent procedures required by applicable law.

34. Changes to this Policy
This Policy may be updated where laws, services, servers, Comment/Cubic App/Friend/Reward functionality or personal-information processing practices change. Material changes will be notified in the manner required by applicable law.
